The Namibian Association of Medical Aid Funds (Namaf) has welcomed a High Court judgment dismissing a challenge brought by Olympia Eye Institute Private Hospital.
It says the ruling provides important clarity on the association’s role in administering practice numbers and the regulatory boundaries within which it must operate. The High Court ruling potentially reinforces Namaf’s role as an important gatekeeper within Namibia’s medical-aid administration, while simultaneously underscoring that the association’s evaluative powers are not unlimited.
The judgment, delivered on 7 August 2026 in the case of Olympia Eye Institute Private Hospital against the Namibia Association of Medical Aid Funds and others, comes as Namibia’s healthcare industry grapples with increasingly specialised medical services, new technologies and evolving models of care that do not always fit neatly into established medical-aid coding and classification systems.
The High Court dismissed Olympia Eye Institute’s application with costs. In alternative observations, the court confirmed that Namaf performs an evaluative function in administering the practice-number system, while emphasising that this function must be exercised within the confines of the Medical Aid Funds Act, applicable regulations and Namaf’s published requirements.
