The Supreme Court of Namibia has held that the designation of a chief and establishment of traditional authority where another already exists for persons of that community would be inconsistent with the statutory purpose of the Traditional Authorities Act.
The ruling was handed down by an appeal court bench comprising of Justice Peter Shivute and acting justices Hosea Angula and Dave Smuts.

The appeal application was lodged by the Hoveka Traditional Authority (HTA), its chief Turimuro Hoveka, the Minister of Urban and Rural Development and other governmental officials.
The appeal was against a High Court review judgement that found in favour of the Ovambanderu Traditional Authority (OTA).
Dispute
The Hoveka clan allegedly made several unsuccessful applications to the urban and rural minister spanning over several years for recognition as a traditional authority and for the designation of a chief.
